First National Collection Bureau Inc. alleged to have sent misleading collection letter

Late 04

MIAMI – A Broward County consumer is accusing a Nevada debt collector of misleading practices.

Ruby Valle filed a complaint on Nov. 20 in the U.S. District Court for the Southern District of Florida against First National Collection Bureau Inc. alleging violation of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in October, she received a collection letter from the defendant. The plaintiff holds First National Collection Bureau Inc. responsible because the suit states the plaintiff defaulted on the alleged debt more than five years ago and that the debt is time-barred, and that the collection letter sent to her did not specify that making a payment on the debt would revive the statute of limitations.

The plaintiff seeks statutory and actual damages, injunction against the defendant, all legal fees and any other relief as the court deems just. She is represented by Jibrael S. Hindi

of The Law Offices of Jibrael S. Hindi in Fort Lauderdale and Thomas J. Patti of Thomas-John Law PA in Fort Lauderdale.
