Former Magnum Coatings employee claims he is owed unpaid wages

ORLANDO – A Tampa man claims his former Brandon employers did not properly compensate him for overtime hours that he worked.

Brian De Leon filed a complaint on Nov. 18 in the U.S. District Court for the Middle District of Florida against Magnum Coatings Inc. and Eric T. Gordon citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation during his employment from July to September. The plaintiff holds Magnum Coatings Inc. and Gordon responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums for working more than 40 hours. He also alleges that one of his paychecks could not be cashed due to insufficient funds.

The plaintiff requests a trial by jury and seeks overtime wages, salary, benefits and other compensation denied to the plaintiff, interest, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Catalina M. Avalos of Tripp Scott PA in Fort Lauderdale.
