Property owner alleges insurance company failed to cover damages

BUNNELL — A Flagler County property owner is is suing an insurance company, alleging breach of contract in failing to cover damages.

Coconut Island LLC filed a lawsuit Nov. 3 in Flagler County Circuit Court against American Economy Insurance Company alleging the insurer breached its duty of good faith and fair dealing.

According to the complaint, April 23, 2015, Coconut Island's property was damaged by water due to a broken pipe. As a result, the suit says, the property required repairs and replacement, cleaning and other remedial measures.

Coconut Island alleges it gave timely notice of the loss to American Economy but the defendant failed to cover damages sustained by the plaintiff. 

The plaintiff alleges American Economy Insurance failed to establish it had reasonable proof that it was not responsible for the payment of damages and/or loss, and failed to pay the requested amount plus interest.

Coconut Island seeks trial by jury, damages, interest, attorney fees and costs of court, plus all relief the court deems just. It is represented by attorney Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
