Former employee accuses paving company of not paying overtime

FORT LAUDERDALE — A former employee is suing a paving company and officials, alleging violations of Fair Labor Standards Act (FLSA) by failing to pay overtime.

Randolph Timothy Johnson filed a lawsuit Nov. 15 in U.S. District Court for the Southern District of Florida against Southern Florida Paving Group LLC, doing business as a Charlie Frymyer Paving, Trident Trucking LLC, Frank A. Bou, Luis Sanchez and David Bou, alleging failure to pay employees the correct rate for all hours worked.

According to the complaint, Johnson worked for the defendants as a paving laborer but failed to receive overtime wages of one and one-half times his regular hourly rate for all hours worked of more than 40 each week. This caused him to suffer monetary losses, the suit says. 

The plaintiff alleges the defendants denied Johnson of his right to receive overtime wages for every hour worked and showed reckless disregard for the provisions of the FLSA concerning the proper payment and recording of overtime wages.

Johnson seeks trial by jury, judgment, jointly and severally, plus costs, reasonable attorney fees and all other remedies the court deems just. He is represented by attorney Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
