Fabricating By Design alleged to have not paid two employees overtime wages

TAMPA – Former employees of a Sarasota business allege they were not paid overtime wages.

Juan Alberto and Jeremy Glenn filed a complaint on Nov. 7 in the Tampa Division of the Middle District of Florida against Dany's Home Remodeling Inc., doing business as Fabricating By Design, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they were employed by the defendant at different times as hourly-paid installers. They allege that although they routinely worked in excess of 40 hours per week as part of their regular job duties, the defendant failed to pay them overtime compensation at a rate of time-and-one-half.

The plaintiffs hold Dany's Home Remodeling Inc. responsible because the defendant allegedly denied plaintiffs of their rights to receive overtimes wages, failed to maintain proper time records as mandated by law and failed to post informational posters as required by law.

The plaintiffs request a trial by jury and seek judgment in their favor, unpaid overtime compensation, damages, interest, attorney's fees, costs and expenses of litigation and further relief the court deems just. They are represented by Kimberly De Arcangelis of Morgan & Morgan PA in Orlando.
