Guardian Life Insurance accused of wrongfully denying man's disability benefit claim

TAMPA – A man alleges an insurer doing business in Hernando County has wrongfully denied him disability benefits.

Barry Weber filed a complaint on Nov. 7 in the U.S. District Court for the Middle District of Florida against The Guardian Life Insurance Co. of America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he was denied benefits under the long-term disability insurance plan funded and administered by the defendant. The plaintiff believes that the defendant's decision to deny him of payment of benefits were highly influenced by its conflicting duties to him and its shareholders, despite his eligibility to receive benefits and being subjected to an unreasonable claims process by the defendant.

The plaintiff holds The Guardian Life Insurance Co. of America responsible because the defendant allegedly failed to pay disability benefit payments to plaintiff and subjected him to an unreasonable claims process.

The plaintiff requests a trial by jury and seeks judgment in his favor, reinstatement of benefits, plus interest, costs, attorney's fees and further relief as the court deems just. He is represented by William S. Coffman of Coffman Law in Tampa.
