Worker accuses food service business of failing to pay overtime

MIAMI — A Miami-Dade County man is suing a food services business, alleging failure to pay overtime.

Adrean Martinez filed a lawsuit Nov. 10 in U.S. District Court for the Southern District of Florida Miami Division against Ovations Food Services LP, alleging violation of the Fair Labor Standards Act.

According to the complaint, Martinez worked for more than 40 hours per week at the defendant's Brava restaurant in Miami without being paid any overtime compensation. The plaintiff alleges the defendant failed to pay the plaintiff any overtime premium for working more than 40 hours as required by FLSA.

Martiznez seeks trial by jury, all unpaid overtime wages, liquidated damages, all legal fees and all other relief the court deems just. He is represented by attorney Robert W. Brock II of Law Office of Lowell J. Kuvin in Miami.
