JACKSONVILLE — A policy holder is suing insurance companies, alleging breach of contract by failing to provide benefits.
Kathleen Mathis filed a lawsuit Nov. 3 in U.S. District Court for the Middle District of Florida against CSX Corporation Short Term Disability Plan and Metropolitan Life Insurance Company, alleging lack of good faith and fair dealing.
According to the complaint, on May 7, 2015, Mathis filed for short-term disability benefits and was initially found eligible. However, the suit says, she later received a letter from the defendants terminating her benefits.
The lawsuit states Mathis requested reconsideration but the defendants upheld their previous decision to deny her benefits. The plaintiff alleges the defendants failed to pay disability benefit payments, and caused her monetary losses including counsel fees.
Mathis seeks trial by jury, unpaid disability benefits plus interest, attorney fees and costs of court. She is represented by attorney Erik Berger of Law Office of Erik W. Berger in Jacksonville.
