Orange County couple accuses Geico of contract breach

ORLANDO — An Orange County couple is suing Geico, alleging breach of contract regarding a vehicle crash.

Catherine and Jeffrey Ellingworth filed a lawsuit Nov. 4 in Orange County Circuit Court against Geico General Insurance Company, alleging lack of good faith and fair dealing.

According to the complaint, on March 11, 2015, Catherine Ellingworth was driving along South Orlando Avenue in Orange County. The suit says a vehicle driven by underinsured/uninsured motorist Morgan Jose Duncan struck Ellingworth's vehicle, causing her to suffer bodily injuries, disfigurement, disability medical expenses and loss of earnings.

The lawsuit states Jeffrey Ellingworth suffered loss of consortium, society, and affection of his wife to the detriment of their marital relationship. The plaintiffs allege Geico has failed to make payments covering the crash after Duncan failed to be on a proper lookout for other vehicles and failed to operate and maintain vehicle so as not to harm others.

The Ellingworths seek trial by jury, damages of more than $15,000 plus, interest and costs. They are represented by attorney Jeremy L. Hogan of Hogan & Hogan PA in Orlando.
