ORLANDO – A Davie contractor alleges it was not paid for work on a federal project.
The United States of America, for the use and benefit of Betancourt Construction Inc., filed a complaint on Nov. 2 in the U.S. District Court for the Middle District of Florida against Travelers Casualty and Surety Co. of America and Federal Insurance Co. alleging breach of Miller Act payment bond.
According to the complaint, the plaintiff alleges that Betancourt Construction Inc. entered into a subcontract with the general contractor for a construction project at the U.S. Naval Base in Cuba with the defendants as sureties. Betancourt Construction Inc. alleges it is still owed principal amount of $991,165.64 for furnishing labor and materials to the project. The plaintiffs hold Travelers Casualty and Surety Co. of America and Federal Insurance Co. responsible because the defendants allegedly failed to provide amount due and owing to Betancourt under the payment bond.
The plaintiff requests a trial by jury and seeks judgment against the defendants, damages in principal sum of $991,165.64, plus interest, costs, attorney's fees and other relief the court deems just. They are represented by Alexander Barthet of The Barthet Firm in Miami.
