Synchrony Bank accused of harassing consumer with phone calls

FORT LAUDERDALE – A Broward County alleges a debt collector invaded his privacy with its frequent phone calls.

Mahmoud Abdelaziaz filed a complaint on Oct. 29 in the U.S. District Court for the Southern District of Florida against Synchrony Bank alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that on Feb. 2, he began receiving calls on his cellphone from the defendant seeking to recover an alleged debt. He claims that the calls were made using an automatic telephone dialing system or an artificial or prerecorded voice and that despite plaintiff’s repeated express revocation of any consent defendant may have had to place calls to his cellphone, the defendant continued its campaign of abusive calls.

The plaintiff holds Synchrony Bank responsible because the defendant allegedly called and left messages to plaintiff with such frequency meant to abuse or harass, contacted plaintiff without express consent and invaded plaintiff's rights to privacy and seclusion.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, costs, interest, attorneys' fees, enjoinder from further violations of these parts, and any other relief the court may deem just.
