Consumer claims Diversified Consultants used automatic dialing system to collect alleged debt

JACKSONVILLE – A consumer alleges a debt collector invaded her privacy by frequently calling her.

Linda Almodovar filed a complaint on Oct. 28 in the U.S. District Court for the Southern District of Florida against Diversified Consultants alleging violation of the Telephone Consumer Protection Act, the Fair Debt Collection Practices Act and Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in July 2016, she started receiving unsolicited calls from the defendant, believed to be using an automatic telephone dialing system or a pre-recorded or artificial voice, in its attempt to collect an alleged medical debt from plaintiff, without acquiring a prior express consent to call. She alleges she suffered invasion of her rights to privacy and seclusion, wasted time, depleted battery life, embarrassment, anguish, depression and unwarranted stress.

The plaintiff holds Diversified Consultants responsible because the defendant allegedly called plaintiff numerous times in a campaign designed to apply maximum psychological stress, abuse and harassment, and contacted plaintiff without any prior express consent.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages and further relief as justice may require. She is represented by George N. Andrews of Loan Lawyers LLC in Fort Lauderdale.
