Motorist claims Amica Mutual Insurance Co. failed to pay for accident coverage

WEST PORT RICHEY — A motorist is suing Amica Mutual Insurance Co., an insurer, citing alleged breach of contract.

Brian Wise filed a complaint on Oct. 17, in the Pasco County Circuit Court against Amica Mutual Insurance Co. alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Nov. 1, 2012, while he was driving along Massachusetts Avenue, he was involved in an accident when an uninsured/underinsured motorist named Daniel James Blatz suddenly struck plaintiff's vehicle, thereby causing plaintiff pain and suffering, disability, mental anguish, loss of capacity for the enjoyment of life, medical expenses and lost earnings. 

The plaintiff holds Amica Mutual Insurance Co. responsible because the defendant allegedly refused to pay pursuant to the policy of uninsured/underinsured motorists coverage and caused plaintiff to retain and pay for legal counsel.

The plaintiff requests a trial by jury and seeks judgment for damages against defendant. He is represented by Stephanie M. Valentine of Andriotis Law Firm PA in Tarpon Springs.
