Former Norman's Tavern dishwasher alleges he is owed unpaid overtime wages

MIAMI – A Dade County man formerly employed as a dishwasher alleges he worked an average of 55 hours a week and was not paid overtime.

Florencio Alvarenga Barahona filed a complaint on behalf of all others similarly situated on Nov. 1 in the U.S. District Court for the Southern District of Florida against North Beach Tavern LLC, doing business as Norman's Tavern, and Lara Yagiro alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime compensation during his employment from June 2015 to October. The plaintiff holds North Beach Tavern LLC, doing business as Norman's Tavern, and Yagiro responsible because the defendants allegedly failed to pay the plaintiff at a rate of time-and-one-half for any hours worked beyond 40.

The plaintiff requests a trial by jury and seeks double damages, all unpaid overtime wages, all legal fees and interest, plus any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
