Employee accuses home improvement company of wrongful termination after he complained about unpaid wages

ORLANDO — An individual is suing JF & MB Home Improvement & Landscaping Inc., and Jorge A. Matute, Florida corporation, citing alleged breach of lease agreement, retaliation and unpaid wages.

Fausto Chacon filed a complaint on Oct. 20, in the U.S. District Court for the Middle District of Florida against the defendants alleging that they failed their duties to pay employees for all hours worked at a correct rate.

According to the complaint, the plaintiff alleges that, in July 2014, he and defendant were engaged in an implied agreement whereby he would be employed by defendants and would be properly paid for all work done. However, plaintiff was not paid proper overtime hours worked and minimum applicable hourly wage. Consequently, he was terminated as a retaliation by the defendants for his repeated complaints of their unfair practices. 

The plaintiff holds JF & MB Home Improvement & Landscaping Inc., and Jorge A. Matute responsible because the defendants allegedly failed to pay the amount due to plaintiff for services provided, and terminated plaintiff's employment as a retaliation for her repeated complaints.

The plaintiff requests a trial by jury and seeks judgment in his favor, damages, costs of action, attorneys' fees and further relief as the court deems just. He is represented by Peter M. Hoogerwoerd and Waynice A. Green of Remer & Georges-Pierre PLLC in Miami.
