ORLANDO – An Orange County woman alleges she was not paid overtime or paid any wages at all during a period of employment.
Eliani Gil filed a complaint on behalf of and other similarly situated individuals on Oct. 20, in the U.S. District Court for the Middle District of Florida against
Mideal Food Service LLC, doing business as Punto Latino Restaurant and Bakery; Leonardo G. Correia, Elias David Munoz, Julio Pena, Danilo Arsenijevith, Manuel Jimenez, Ideal Food Distributors LLC and Edwin Perez
alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that from June 2015 through Nov. 17, 2015, she was employed by the defendants. She alleges she worked approximately 10 overtime hours each week, but was not paid the proper overtime rate of one-and-a-half for all overtime hours worked. She also alleges that she has not received any compensation since October 2015.
The plaintiff holds the defendants responsible because the defendants allegedly showed reckless disregard of the provisions of FLSA, failed to posts required notices of employees' federal rights to overtime and minimum wages and refused to properly pay plaintiff's wages as required by law.
The plaintiffs request a trial by jury and seek judgment against defendants, damages, unpaid wages and interest, cost of action, attorney's fees and other relief as may be just. She is represented by Anthony M. Georges-Pierre of Remer & Georges-Pierre PLLC in Miami.
