Employee accuses AWP Windows and Door, LLC of wrongful termination

MIAMI — An employee is suing AWP Windows and Door, LLC, an employer, citing alleged violation of the Family and Medical Leave Act (FMLA).

Gretel Guerra filed a complaint on Oct. 27, in the U.S. District Court for the Southern District of Florida Miami Division against AWP Windows and Door, LLC alleging that the employer terminated plaintiff for exercising her rights to FMLA.

According to the complaint, the plaintiff alleges that, in 2016, she suffered damages from being terminated due to her medical condition. The plaintiff holds AWP Windows and Door, LLC responsible because the defendant allegedly terminated plaintiff's employment for requesting a leave that was supposed to be protected by FMLA.

The plaintiff requests a trial by jury and seeks compensation for lost wages, benefits and other remuneration, reinstatement, back pay plus interest, front pay, liquidated damages, interest, all legal fees and any other relief as this court deems just. The plaintiff is represented by Luis A. Cabassa of Wenzel Fenton Cabassa, P.A. in Tampa.
