Manufacturer accuses GarageWatches LLC of trademark infringement

MIAMI — A manufacturer is suing GarageWatches LLC, an online seller, citing alleged trademark infringement.

TM Brands LLC filed a complaint on Oct. 14, in the U.S. District Court for the Southern District of Florida against GarageWatches LLC alleging that the online seller obtained profit through the use of infringing trademarks.

According to the complaint, the plaintiff states that TM Brands LLC is the owner of various trademarks, including those used on an eyewear that the plaintiff discovered was being sold on Amazon by the defendant, which the defendant apparently bought from Dimitri & Co. It has already been a year since plaintiff has terminated Dimitri & Co.'s license to sell, thereby causing plaintiff to suffer from loss of profits. 

The plaintiff holds GarageWatches LLC responsible because the defendant allegedly distributed infringing products without the proper permission from plaintiff and obtained profits at the expense of plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, interest, unfair competition, costs, and further relief as may be deemed just. They are represented by Glen H. Waldman of Heller Waldman PL in Coconut Grove.
