Woman claims Liberty Life wrongfully terminated disability benefits

PENSACOLA – A former Family Dollar Stores employee alleges her disability benefits were unlawfully terminated.

Roxanne Hurley filed a complaint on Oct. 10 in the U.S. District Court for the Northern District of Florida, Pensacola Division against Liberty Life Assurance Co. of Boston, doing business as Liberty Mutual Insurance, alleging citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in September 2014 , she went on a medical leave due to left knee surgery and received disability benefits through July 2015 until further payment was denied by the defendant. On Sept. 29, 2015, she alleges withdrew from work permanently, this time due to right knee surgery. She alleges long-term disability benefits were paid through Feb. 16 but that the defendant has failed to pay further benefits.

The plaintiff holds Liberty Life Assurance Co. of Boston responsible because she alleges the benefits are permitted under the plan and that she has satisfied all conditions to be eligible for the benefits.

The plaintiff requests a trial by jury and seeks judgment against defendant, receive long-term disability benefits, interest, attorney's fees, costs and further relief as the court deems just. She is represented by Jack De La Piedra of De La Piedra Law Firm PA in Gulf Breeze.
