Woman seeks for Aetna Life to reinstate her to receive disability benefits

Insurance 06

MIAMI – A woman seeks reinstatement to her disability benefit plan after she alleges benefits were wrongfully terminated.

Samantha Holt filed a complaint on Oct. 14 in the U.S. District Court for the Southern District of Florida against Aetna Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2015, she became disabled and was initially being paid disability benefits until the benefits were terminated. The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly upheld its decision to deny further payment of plaintiff's disability benefits despite her still being disabled according to the terms of the plan.

The plaintiff seeks payment of disability benefits due to her, reinstatement, all legal fees and interest plus any other relief the court deems just. She is represented by Alexander A. Palamara and Gregory Michael Dell of Attorneys Dell and Schaefer Chartered in Hollywood.
