Man alleges Bank of America harassed him with hundreds of calls

GAINESVILLE A Georgia consumer alleges a bank has called him more than 500 times over an alleged debt.

Jason Heller filed a complaint on Oct. 4 in the U.S. District Court for the Northern District of Florida, Gainesville Division against Bank of America alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that since 2012, the defendant has called numerous times in an attempt to collect an alleged debt. The plaintiff believes the calls were made using an automatic telephone dialing system or a pre-recorded or artificial voice.

The plaintiff holds Bank of America responsible because the defendant allegedly contacted plaintiff with such frequency that was meant to harass or abuse and continued calling plaintiff despite him revoking any prior express consent.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages, punitive damages, actual damages, and other relief the court may deem just. He is represented by William Peerce Howard, Amanda J. Allen and Stefan A. Alvarez of The Consumer Protection Firm PLLC in Tampa.
