Customer claims store display at a CVS caused her to fall

JACKSONVILLE – A Georgia woman alleges she was injured at a Jacksonville pharmacy.

Nancy Gillette filed a complaint on Oct. 11 in the 4th Judicial Circuit Court for Duval County against CVS Pharmacy Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 30, 2014, she was in the premises of defendant's store on Race Track Road, when she tripped on an end display, which caused her to fall and sustain physical injuries, pain and suffering, disability, inconvenience, disfigurement, scarring, mental anguish, medical expenses and loss of earning capacity. 

The plaintiff holds CVS Pharmacy Inc. responsible because the defendant allegedly failed to adequately warn plaintiff about the dangerous condition of the area and failed to take reasonable remedial measures to make the area safe for the public.

The plaintiff requests a trial by jury and seeks judgment against defendant of more than $15,000 plus costs and other relief as may be justly entitled. She is represented by Kenneth W. Mastrilli of The Pawlowski/Mastrilli Law Group in Tampa.
