ARS National Services Inc. claimed to have sent misleading letter regarding alleged debt

MIAMI – A Broward County consumer alleging that a California debt collector sent a collection letter that contained false representations regarding her purported debt.

Jennipher Perez filed a complaint on Oct. 8 in the U.S. District Court for the Southern District of Florida against ARS National Services Inc. citing the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in August, she received a collection letter for an alleged debt she owed from the defendant. The plaintiff holds ARS National Services Inc. responsible because the defendant allegedly made misrepresentations to plaintiff that there would be tax consequences of accepting the defendant's offer to settle the alleged debt for less than the full balance.

The plaintiff requests a trial by jury and seeks statutory and actual damages, injunction against the defendant, all legal fees and any other relief the court deems just.
