Chubb Custom Insurance Co. accused of breach of contract over insurance claim

CLEARWATER – The owner of a Clearwater property alleges it was not fully compensated for damages but its insurer.

City Square LLC filed a complaint on Oct. 6 in the 6th Judicial Circuit Court of Florida - Pinellas County against Chubb Custom Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that, on March 1, 2011, City Square LLC's property, which was under insurance policy with defendant, was damaged as a result of theft, vandalism and water loss. Although the plaintiff claims it has furnished defendant with documents needed to recover losses under the policy, defendant has refused to pay the full amount of its claims. It alleges it suffered damages because it has not been compensated.

The plaintiff holds Chubb Custom Insurance Co. responsible because the defendant allegedly denied coverage and refused to pay any or full amount of the claim and breached contract of insurance by not compensating for the damages sustained by plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendant, interest, attorney's fees, costs and other relief that the court deems just. It is represented by John A. Salcedo of The Mineo Salcedo Law Firm PA in Davie.
