TAMPA – A Hillsborough County consumer alleges a Minnesota-based creditor harassed her with the frequency of its collection calls.
Yajairis Vargas filed a complaint on Oct. 3 in the Tampa Division of the Middle District of Florida against Bluestem Brands Inc., doing business as Fingerhut, alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that she received between two to five calls per day over the last four years to her cellular telephone from defendant in its attempt to collect a consumer debt using an automatic telephone dialing system or a pre-recorded or artificial voice. She alleges that she demanded that defendant cease placing calls to her cellular telephone number, however, its agents continued calling her despite having revoked any express consent, thereby causing her to suffer injury of invasion of privacy and intrusion upon her right of seclusion.
The plaintiff holds Bluestem Brands Inc. responsible because the defendant allegedly contacted plaintiff with such frequency that was meant to harassed or abuse plaintiff and utilized an automatic telephone dialing system or pre-recorded or artificial voice without plaintiff’s prior express consent.
The plaintiff requests a trial by jury and seeks judgment in her favor, damages, declaratory relief, permanent injunction, litigation expenses, costs of suit and further relief as the court may deem just. She is represented by Christopher Legg of Buchwald Legg PLLC in Hollywood.
