ORLANDO – A former server at an Orlando restaurant alleges it failed to provide fair compensation to him for his work.
Austin Wupperman filed a complaint on Oct. 6 in the
9th Judicial Circuit Court of Florida - Orange County
against OS Restaurant Services LLC, also known as Outback Steakhouse of Florida LLC and doing business as Outback Steakhouse alleging violation of the Fair Labor Standards Act and the Florida Minimum Wage Act.
According to the complaint, the plaintiff alleges that between November 2014 and August 2015, he suffered damages from not being paid regular wages. The plaintiff holds OS Restaurant Services LLC responsible because the defendant allegedly improperly applied a tip credit to every hour he worked, even when he was performing nontipped tasks, and because of this the plaintiff did not make a minimum wage.
The plaintiff requests a trial by jury and seeks liquidated damages, all unpaid wages, interest, all legal fees and any other relief as the court deems just. He is represented by Michael L. Grossman of Cohen Grossman, Attorneys at Law in Maitland.
