Passenger claims leg was injured during transfer from cruise ship to tender boat

MIAMI – A woman alleges her leg was crushed between a cruise ship and a tender boat.

Karen Smeets filed a complaint on Oct. 4 in the U.S. District Court for the Southern District of Florida, Miami Division against NCL (BAHAMAS) LTD, doing business as Norwegian Cruise Line, and NCL Corporation LTD, alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 13, 2015, she was boarding a tender boat from the cruise ship when her leg was smashed between the two vessels, causing fractures. The plaintiff holds NCL (BAHAMAS) LTD and NCL Corporation LTD responsible because the defendants allegedly failed to properly train its crew members how to safely assist passengers during the transfer process and failure to exercise reasonable care.

The plaintiff requests a trial by jury and seeks damages plus interest, all legal fees and any other relief as the court deems just. She is represented by Robert D. Peltz of The Peltz Law Firm PA in Miami and Michael Sutton of Sutton & Murphy in Mission Viejo, California.
