TAMPA – A woman claims she was terminated by her Hillsborough County employer for absences that are protected under federal law.
Barbara Hernandez filed a complaint on Sept. 22 in the
13th Judicial Circuit Court for Hillsborough County against NSN Revenue Resources LLC alleging violation of the Family and Medical Leave Act.
According to the complaint, the plaintiff alleges that on April 21 she became ill with a severe health condition and was not allowed by her physician to go back to work until April 26. The following day, she alleges she contacted the defendant and said she was unable to work and requested medical leave, but was given only two days to send proper medical documentation. Because of the limited time, plaintiff was not able to send the documentation until May 2. She alleges she was terminated by the defendant for absences on April 29.
The plaintiff holds NSN Revenue Resources LLC responsible because the defendant allegedly failed to give plaintiff reasonable time limitations to submit proper medical documentation, failed to uphold rights of plaintiff to medical leave and retaliated against plaintiff by terminating employment.
The plaintiff requests a trial by jury and seeks judgment in her favor, compensation for lost wages and benefits, reinstatement to a previous/comparable position, front pay, damages, interest, costs, attorney's fees and further relief as the court deems just.
