State Farm accused of not providing full value of driver's claim after accident

ORLANDO – A motorist alleges his insurance company refused to pay for the full amount of his damages after an auto accident in Orange County.

Jose Quinones filed a complaint on Sept. 1 in the 9th Judicial Circuit Court for Orange County against State Farm Mutual Automobile Insurance Co. alleging that the insurer failed to provide claims due under insurance plan.

According to the complaint, the plaintiff alleges that on Nov. 5, 2015, he was operating a motor vehicle near the intersection of state Road 527 and Holden Avenue, when it was struck by Alvin Ubieta. As a result, plaintiff alleges he suffered from disability, disfigurement, impairment, mental anguish, aggravation of an existing condition, medical expenses, loss of earnings, and loss of ability to lead a normal life. The suit states that Ubieta was uninsured/underinsured and did not have enough insurance coverage to cover plaintiff's damages and that the defendant failed to pay the plaintiff the full value of his claim.

The plaintiff holds State Farm Mutual Automobile Insurance Co. responsible because the defendant allegedly refused to pay plaintiff for the full value of the claim, despite timely notice of the automobile accident and proof of the claim for damages.

The plaintiff requests a trial by jury and seeks judgment against defendant and for other relief deemed proper by the court. He is represented by Jason P. Herman of Dan Newlin & Partners in Orlando.
