First Premier Bank accused of telephone harassment

ORLANDO – A Daytona consumer claims a South Dakota-based debt collector harassed her with calls.

Teresa Latimore filed a complaint on Sept. 26 in the U.S. District Court for the Middle District of Florida, Orlando Division against First Premier Bank alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that since March, the defendant has called her more than 100 times in an attempt to collect an alleged debt. The plaintiff holds First Premier Bank responsible because the defendant allegedly used an automatic telephone dialing system to contact plaintiff and continued to call after she revoked her permission.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, all legal fees and interest, plus any other relief as the court deems just. She is represented by Amy Ferrera of Morgan & Morgan Tampa PA in Tampa.
