Employee alleges Bank of America Corp. wrongfully denied short-term disability benefits

TAMPA – A former employee alleges Bank of America Corp. wrongfully denied short-term disability benefits.

Ferlin Otto filed a complaint on Sept. 26 in the Tampa Division for the Middle District of Florida against Bank of America Corp. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he suffered damages from being denied short-term disability benefits in July 2015. The plaintiff holds Bank of America Corp. responsible because the defendant allegedly refused to pay plaintiff for benefits despite being disabled according to the terms of the plan.

The plaintiff seeks declaration that he is entitled for disability benefits, award benefits plus interest, all legal fees and any other relief as the court deems just. He is represented by Donald C. Anderson Jr. of Law Offices of Donald Carl Anderson in St. Petersburg.
