MIAMI – A Broward County resident is accusing a Houston, Texas debt collector of illegal practices.
Ana Pimentel filed a complaint on Sept. 26 in the U.S. District Court for the Southern District of Florida against AvanteUSA LTD alleging violation of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that in January, she received a collection letter from the defendant. The plaintiff holds AvanteUSA LTD responsible because she allegedly did not receive any written notice of the assignment of the debt 30 days before collection activity began.
The plaintiff requests a trial by jury and seeks statutory and actual damages, injunction against the defendant, all legal fees and any other relief as the court deems just.
