ORLANDO – An African-American man alleges that he was terminated from a Flagler Beach business because of his race.

Derrell Newsome filed a complaint on Sept. 20 in the U.S. District Court for the Middle District of Florida, Orlando Division against Sea Ray Boats Inc. alleging that the manufacturer violated the Federal Equal Employment Opportunities Act.

According to the complaint, the plaintiff alleges that beginning on June 16, 2014, he was employed as a lamination technician for defendant's boat manufacturing business, until he was suspended and subsequently terminated on June 29, 2015. The suit states the defendant cited plaintiff's act of throwing an item in the workplace as the reason of termination. While plaintiff acknowledged his action, the suit states he was not the only employee who had done such act and that other similarly situated Caucasian employees were not terminated, but only suspended.

The plaintiff holds Sea Ray Boats Inc. responsible because the defendant allegedly failed to give equal treatment to all employees and for retaliation.

The plaintiff requests a trial by jury and seeks judgment in his favor, damages, costs, disbursements, attorney's fees and further relief as the court deems just. He is represented by David W. Glasser in Daytona Beach.
