FORT LAUDERDALE – A Fort Lauderdale company that offered psychic reading services from Miss Cleo in the 1990s alleges its marks were used to advertise cosmetics.

Psychic Readers Network Inc. filed a complaint on Sept. 22 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against LVMH Moet Hennesy Louis Vuitton Inc.; Benefit Cosmetics LLC; The Eighth Floor Inc.; Generocity Media Partners Inc., doing business as Mediaone; and John Does 1-10 alleging copyright infringement, unfair competition and other counts.

According to the complaint, the plaintiff is the owner of the marks related to the Miss Cleo psychic adviser persona. It alleges that Benefit Cosmetics began using the plaintiff's Miss Cleo marks and had an advertising campaign with Youree Dell Harris (Miss Cleo) for its products.

The plaintiff holds LVMH Moet Hennesy Louis Vuitton Inc.; Benefit Cosmetics LLC; The Eighth Floor Inc.; Generocity Media Partners Inc., doing business as Mediaone; and John Does 1-10 responsible because the defendants allegedly used plaintiff's mark without authorization to advertise the products.

The plaintiff requests a trial by jury and seeks statutory and compensatory damages, permanent injunction against the defendants, benefits they have acquired through the use of plaintiff's trademark, interest, all legal fees and any other relief the court deems just. It is represented by Scott Cosgrove of Leon Cosgrove LLC in Coral Gables and Joel R. Dichter of Dichter Law LLC in New York.
