Class action filed against Credit Control Services over allegedly misleading letter

MIAMI – A St. Lucie County consumer alleges a Massachusetts-based debt collector mailed her a misleading collection letter and has filed a class-action suit.

Teri Freund filed a complaint on behalf of all others similarly situated on Sept. 22 in the U.S. District Court for the Southern District of Florida against Credit Control Services Inc. alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff states that in September 2016, the defendant mailed a demand letter regarding her alleged medical debt. The plaintiff holds Credit Control Services Inc. responsible because the defendant allegedly did not state in the letter that the plaintiff may dispute the debt and claims the letter was misleading and confusing.

The plaintiff seeks statutory damages, all legal fees and interest, and any other relief as the court deems just. She is represented by Leo W. Desmond and Sovathary K. Jacobson of Desmond Law Firm PC in Vero Beach.
