Steller Recovery Inc. accused of not marking debt as disputed on man's credit report

FORT LAUDERDALE – A Davie man is suing a Jacksonville debt collector over allegations of unfair debt collection practices.

Charles McKay filed a complaint on Sept. 14 in the U.S. District Court for the Southern District of Florida against Stellar Recovery Inc. citing the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that on Jan. 18, he disputed an alleged debt through a letter to the defendant. He alleges that upon examining his credit report again on March 4, the defendant had not removed the credit account nor marked it as ''disputed by consumer'' despite being required to do so by the FDCPA, which caused plaintiff to suffer damages. 

The plaintiff holds Stellar Recovery Inc. responsible because the defendant allegedly failed to list the account as a disputed debt or remove the account from the credit reporting agency.

The plaintiff requests a trial by jury and seeks judgment against defendant, actual and statutory damages, attorney's fees, costs, expenses, disbursement and further relief as the court may deem just. He is represented by Michael Jay Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
