Dade County man alleges he was not paid overtime for warehouse job

MIAMI – A Dade County man alleges his former employer did not pay him overtime wages.

Joel Lago Zaragoza filed a complaint on behalf of all others similarly situated on Sept. 14 in the U.S. District Court for the Southern District of Florida against Frank Ortega citing the Fair Labor Standards Act, breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that he was employed by the defendant as a warehouse worker for Radar PL Manufacturing Corp. from March 2012 to May 31. He alleges that for a period he worked for more than 40 hours without being paid the overtime rate of time-and-one-half and during another period, he was not compensated for his overtime work at all. The plaintiff holds Ortega responsible because the defendant allegedly willfully and intentionally refused to pay plaintiff's overtime wages.

The plaintiff requests a trial by jury and seeks all damages, all legal fees and interest, and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
