Man alleges he was not paid overtime, wrongfully terminated

FORT LAUDERDALE – A Broward County man claims he was not paid overtime and was wrongfully terminated for objecting to allegedly unlawful business practices.

Tom C. Derington filed a complaint on Sept. 14 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Belmar Development Associates LLC, Encore Housing Opportunity Fund II General Partner LLC, Tower 2 LLC and Royal Palm Cos. LLC citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was employed by the defendants from February 2015 to July. He alleges he worked for more than 40 hours without being paid any overtime compensation and was terminated from his employment for objecting to working without a permit on a project and for other complaints.

The plaintiff holds Belmar Development Associates LLC, Encore Housing Opportunity Fund II General Partner LLC, Tower 2 LLC and Royal Palm Cos. LLC responsible because the defendants allegedly refused to pay overtime premiums to plaintiff and for his objections to unacceptable business practices.

The plaintiff requests a trial by jury and seeks reinstatement, lost pay and benefits, compensatory damages and any other relief as the court deems just. He is represented by Lee H. Schillinger of Law Office of Lee H. Schillinger PA in Hollywood.
