Hartford Fire Insurance Co. allegedly failed to pay employees overtime wages

ORLANDO — Former employees have filed a class-action lawsuit against an insurance company for allegedly failing to pay them overtime wages.

Cordell Allen, Alia Clark, Patricia Dearth,Chris Depierro, Jessica Leighton, Jessica Perez, Jamie Rivera, Layfon Rosu, Marissa Shimko and Carol Somers filed a complaint on behalf of themselves and others similarly situated on Sept. 13 in U.S. District Court for the Middle District of Florida, Orlando Division, against Hartford Fire Insurance Co., alleging that the business violated the Fair Labor Standards Act through unfair business practices.

According to the complaint, the plaintiffs allege that in 2000, Cordell Allen, Alia Clark, Patricia Dearth,Chris Depierro, Jessica Leighton, Jessica Perez, Jamie Rivera, Layfon Rosu, Marissa Shimko and Carol Somers and other similarly situated employees, held the title or position of analyst and were or still employed by the defendant, but were not compensated for all hours worked in excess of 40 hours per week, although their positions were not exempt from receiving overtime pay. This purportedly caused the plaintiffs to sustain substantial losses. The plaintiffs hold Hartford Fire Insurance Co. responsible because the defendant allegedly failed to accurately classify employees as non-exempt from overtime pay, failed to keep records of employees' hours worked and failed to pay the legally required one and one-half rate for work in excess of 40 hours.

The plaintiffs request a trial by jury and seek judgment against the defendant, certify the case as a class action suit, for employees to be informed of the nature of action, to enjoin the defendant from withholding overtime compensation, unpaid overtime due, damages, interest, attorneys' fees, costs, and other relief as the court finds appropriate.
