Former Fronton Holdings employees allege they are owed tips

MIAMI – Former poker dealers allege their casino employer required them to pay tips in an invalid tip pool arrangement.

Jorge L. Lopez and Esteban Machado filed a complaint on Sept. 12 in the U.S. District Court for the Southern District of Florida against Fronton Holdings LLC citing the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they worked for defendant as poker dealers and were paid at a rate of minimum wage plus tips, however, they were forced to pay 13 percent of their tips to floor managers, which they allege is an invalid tip pool arrangement. They also allege that during one or more workweeks, the defendant did not pay plaintiffs the full minimum wage.

The plaintiffs hold Fronton Holdings LLC responsible because the defendant allegedly failed to monitor the unpaid and/or underpaid hours worked by the plaintiffs, failed to oversee that tips were being paid to floor managers and failed to pay plaintiffs their full minimum wages in one or more workweeks.

The plaintiffs request a trial by jury and seek judgment against defendant for all unpaid wages, return of all tips paid into the purportedly unlawful tip pool arrangement, liquidated damages, attorney’s fees and costs of suit.
