FORT MYERS — A former maintenance worker has filed suit against a business for alleged unpaid wages after he worked more than 40 hours per week, but was paid a flat weekly rate of $150. 

Daniel Morse filed a complaint Sept. 13 in U.S. District Court for the Middle District of Florida, Fort Myers Division, against Royal Shell Vacations Inc., alleging that the employer failed to provide fair compensation to the plaintiff for his work.

According to the complaint, the plaintiff alleges that between November 2011 and June 2015, he worked for more than 40 hours without being paid any overtime compensation. The plaintiff holds Royal Shell Vacations Inc. responsible because the defendant allegedly refused to pay the plaintiff any overtime premium for hours worked that exceeded 40 per week.

The plaintiff requests a trial by jury and seeks actual and liquidated damages, interest, all legal fees and any other relief as thecourt deems just. He is represented by Jason N. Vishio of Blackwell Vishio & Fisher PLLC in Fort Myers.
