Payless Jewelry alleges Smartwork Media sent junk faxes

FORT LAUDERDALE – A Broward County business has filed a class-action suit against a New York company over allegations it sent unsolicited faxes.

Payless Jewelry #3 Inc. filed a complaint on Sept. 13 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Smartwork Media Inc. citing the Telephone Consumer Protection Act and the Junk Fax Prevention Act.

According to the complaint, the plaintiff alleges that the defendant allegedly attempted to advertise its business to the plaintiff by sending unsolicited fax advertisements without plaintiff's consent in February.

The plaintiff requests a trial by jury and seeks statutory damages, injunction against the defendant, all legal fees and any other relief as this court deems just. It is represented by Joshua H. Eggnatz, Michael J. Pascucci and Seth M. Lehrman of Farmer, Jaffe, Weissing, Edwards Fistos & Lehrman PL in Fort Lauderdale.
