Garrison Property and Casualty Insurance Co. accused of not providing underinsured motorist coverage

JACKSONVILLE – A man has filed suit against his insurer alleging it denied him underinsured motorist coverage after he was injured in an accident.

Rick F. Whitcher filed a complaint on Sept. 7 in the 4th Judicial Circuit Court in Duval County against Garrison Property and Casualty Insurance Co. alleging that the insurer breached an agreement to provide coverage under policy.

According to the complaint, the plaintiff alleges that on March 30, 2015, he was injured in car accident when Martavia D. Collier negligently operated a vehicle that caused a multi-car collision that included his motor vehicle. He claims that due to the extent of injuries and damages suffered by him and Collier being underinsured, she was not able to compensate for damages sustained by plaintiff. The suit states the defendant has denied plaintiff's claim for the full coverage of underinsured motorist (UM) benefits under the policy the plaintiff maintained with the defendant. 

The plaintiff holds Garrison Property and Casualty Insurance Co. responsible because the defendant allegedly failed to pay plaintiff the full UM coverage under the policy and failed to comply with the initial and supplemental civil remedy notices filed by plaintiff.

The plaintiff requests a trial by jury and seeks judgment in his favor, total damages, attorneys' fees and costs. He is represented by Jeffrey R. Bankston and M. Jesse Stern of Buschman, Ahern, Persons & Bankston in Jacksonville Beach.
