Comenity LLC alleged to have called woman more than 600 times

OCALA – A Citrus County consumer alleges that a debt collector has called her several hundred times using an automatic dialing system.

Marisa Digiacomo filed a complaint on Sept. 12 in the U.S. District Court for the Middle District of Florida, Ocala Division against Comenity LLC citing the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff claims that since July 2015, the defendant has called her more than 600 times in an attempt to collect an allege debt. The plaintiff holds Comenity LLC responsible because the defendant allegedly used an automatic telephone dialing system to contact plaintiff despite her requesting that the calls stop.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, all legal fees and interest, and any other relief as the court deems just. She is represented by Frank H. Kerney III of Morgan & Morgan Tampa PA in Tampa.
