JACKSONVILLE – A maintenance worker alleges he was not properly compensated by a Jacksonville employer.
Jovyn Alicea filed a complaint on Sept. 12 in the 4th Judicial Circuit Court - Duval County against Brookdale Senior Living Inc. citing the Fair Labor Standards Act and breach of contract.
According to the complaint, the plaintiff alleges that he was required to be on call every other week and was not compensated for every hour was on call. He also alleges that he was not paid travel time. The plaintiff holds Brookdale Senior Living Inc. responsible because the defendant allegedly failed to pay plaintiff any overtime premiums for hours worked that exceeded 40 per workweek.
The plaintiff seeks nominal damages, unpaid wages, unpaid overtime, liquidated damages, interest, court costs and any other relief as the court deems just. He is represented by Matthew W. Birk of The Law Office of Matthew Birk LLC in Gainesville.
