Photographer alleges Jordan & Skala Engineers used photograph without permission

MIAMI – A German photographer claims a construction engineering firm used his copyrighted photo of the New York City skyline to promote its business without his authorization.

Daniel Foster filed a complaint on Sept. 6 in the U.S. District Court for the Southern District of Florida, Miami-Dade Division against Jordan & Skala Engineers Inc. alleging copyright infringement.

According to the complaint, the plaintiff alleges that his 2012 photograph titled “New York Abstract Architecture” was copied by the defendant to market and promote its business activities and also distributed it on Twitter, LinkedIn and Facebook without consent from plaintiff. He alleges the defendant's action caused him irreparable harm. 

The plaintiff holds Jordan & Skala Engineers Inc. responsible because the defendant allegedly copied, displayed and distributed the work at issue and made derivatives of the work without plaintiff’s authorization.

The plaintiff requests a trial by jury and seeks judgment in his favor, enjoin defendants from further infringement, damages, profits from infringement, attorneys’ fees, costs of suit and further relief as the court deems just.
