T-Mobile USA allegedly retaliated against a former employee for taking time off

TAMPA — A former employee has filed suit against a cellphone provider for allegedly reducing her work schedule after she took time off for a medical issue.

Lena Meadowcroft filed a complaint Sept. 7 in the Tampa Division of the Middle District of Florida against T-Mobile USA Inc., alleging that the employer retaliated against the plaintiff for exercising her rights under the Family Medical Leave Act (FMLA).

According to the complaint, the plaintiff alleges that between May 2009 and February 2011, she suffered a medical condition and had to exercise her rights to FMLA. But upon her return to work, she allegedly was treated differently by her employer. The plaintiff holds T-Mobile USA, Inc. responsible because the defendant allegedly reduced the plaintiff's working hours and purportedly did not allow her to work on the weekends and night shifts, which impacted her pay.

The plaintiff requests a trial by jury and seeks an injunction against the defendant, compensation for lost wages, benefits and other remuneration, reinstatement, back pay with interest, front pay, liquidated damages, all legal fees and and other relief as the court deems just. She is represented by Donna V. Smith of Wenzel Fenton Cabassa P.A. in Tampa.
