MIAMI – Two maintenance workers allege they have not been paid overtime wages since beginning their employment with a condo association in 2008.

Raidel Ramirez Rodriguez and Wilber Perez filed a complaint on behalf of all others similarly situated on Sept. 8 in the U.S. District Court for the Southern District of Florida against Sahara Beach Club Motel Condominium Association Inc. and Dezer Gil citing the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they worked for more than 40 hours for the defendants without being paid any overtime compensation. The plaintiffs holds Sahara Beach Club Motel Condominium Association Inc. and Gil responsible because the defendants allegedly failed to pay overtime premium to plaintiff for hours worked that exceeded 40 per week.

The plaintiffs request a trial by jury and seek double damages, all legal fees, all overtime wages and any other relief as the court deems just. They are represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
