Man alleges he is owed overtime wages by Epoca Corp.

MIAMI – A general laborer alleges he worked approximately 60 hours per week but was not paid overtime wages.

Franklin Cummings filed a complaint on Sept. 5 in the U.S. District Court for the Southern District of Florida against Epoca Corp. citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for the defendant from February 2012 to May. The plaintiff holds Epoca Corp. responsible because the defendant allegedly failed to pay overtime wages for hours worked over 40 hours per week.

The plaintiff requests a trial by jury and seeks payment of all overtime hours at the legal rate, liquidated damages, all legal fees and interest plus any other relief the court deems just. He is represented by Jonathan S. Minick of Jonathan S. Minick PA in Miami.
