FORT LAUDERDALE – A delivery driver alleges he worked approximately 70 hours per week and was only paid $50 per day.
Enrique Torres filed a complaint on Sept. 6 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against
Riceup Asian Kitchen Inc. and Yanhua Li citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between December 2015 and August, he worked for more than 40 hours without being paid any overtime compensation or the regular rate of pay. The suit states he was compensated at a flat rate of $50 per day plus tips, which the defendants took a percentage of. The plaintiff holds Riceup Asian Kitchen Inc. and Li responsible because the defendants allegedly failed to pay the plaintiff a minimum wage or overtime, and terminated him in retaliation for requesting to be properly compensated.
The plaintiff requests a trial by jury and seeks overtime compensation, minimum wage, liquidated damages, all legal fees and interest plus any other relief as the court deems just. He is represented by Noah E. Storch and Richard Celler of Richard Celler Legal PA in Davie.
